Refugee Claims 

A refugee claimant must show that they cannot return to their country of origin because they fear persecution based on race, religion, nationality, political opinion, or membership in a particular social group.  We have strong expertise in representing  individuals forced to flee their countries due to criminalization, discrimination, and social stigma related to their sexual orientation or gender identity. Appeals to the Refugee Appeals Division (RAD) 

The RAD reviews decisions made by the Refugee Protection Division (RPD) and may either allow or dismiss an appeal for refugee protection. Unlike at the RPD, the process at the RAD is primarily written: your lawyer submits legal arguments in writing, and the introduction of new evidence is strictly regulated. 

Appeals to the Immigration Appeal Division (IAD) 

Under the Immigration and Refugee Protection Act, certain decisions by visa officers or the Immigration Division can be appealed to the IAD, including: 

  • Refusal of a family sponsorship 
  • Inadmissibility leading to a removal order 
  • Loss of permanent residence for failing residency requirements 


The IAD may also consider humanitarian and compassionate factors, such as a person’s ties to Canada, the hardships of leaving, and the best interests of any affected children.

Judicial Reviews at the Federal Court 

Judicial review allows a judge to examine certain immigration and refugee decisions, including: 

  • Refusal of refugee status 
  • Refusal of a visa 
  • Refusal of temporary or permanent residence 


We regularly appear before the Federal Court in cases that are important to our clients. 
If you receive a negative refugee or immigration decision in Canada or abroad, you may be able to have it reviewed by the Federal Court of Canada. 
The process has two steps:  
First, a judge must grant leave to have your case heard. If leave is granted, your lawyer can present arguments at a hearing to challenge the decision and seek to have it set aside. 

Removal and Deportation 

We assist clients facing removal or deportation from Canada, providing guidance and representation to protect their rights. These procedures are urgent and highly demanding. We carefully assess your chances of success based on the evidence and facts surrounding your case. 

Deferral of Removal

While a deferral does not cancel or set aside the removal order itself, it allows an individual to remain temporarily in Canada while specific circumstances or pending applications are reviewed by the authorities. 

Stay of Deportation 

We assist you in applying for a judicial stay to temporarily halt the execution of a removal order while your case is under review.

These are highly technical proceedings that require demonstrating to a Federal Court judge that your case raises a serious issue to be tried, that your removal would cause irreparable harm, and that the balance of convenience weighs in your favor.
